New Technology to Reduce Cost and Maximize Success in eDiscovery and GRC
March 11 from 1:00 to 1:30 MST The accelerating growth in the volume of Electronically Stored Information (ESI), the recent and ongoing amendments to the Federal Rules of Civil Procedures (FRCP) and the increase in the number of lawsuits and regulatory inquiries have all combined to create a significant challenge for legal departments. "eDiscovery costs too much." Industry Analysts have concluded that the most expensive part of eDiscovery is document review. Trying and Winning the "Bet the Company" Case - The Inside Story of the Broadcom Trial
On December 15, 2009, Judge Cormac J. Carney of the Central District of California spoke the following words to William J. Ruehle: “Mr. Ruehle, you are a free man.” Judge Carney spoke these remarkable words after a two month trial in which Mr. Ruehle - the former CFO of Broadcom Corporation - had been accused of securities fraud and conspiracy relating to the stock options granting practices at Broadcom from 1998-2003. In addition to acquitting Mr. Ruehle on that date, Judge Carney dismissed the indictments against the co-founders of Broadcom, Dr. Henry T. Nicholas and Dr. Henry Samueli; and dismissed the SEC complaint against Drs. Samueli and Nicholas, Mr. Ruehle and David Dull, Broadcom’s former General Counsel. This program explores various trial techniques utilized in the course of this two month trial and the extraordinary inside story that culminated on December 15 in Judge Carney’s courtroom. This briefing will be conducted by Mr. Ruehle’s lawyer, Richard Marmaro, a partner at Skadden, Arps, Slate, Meagher & Flom LLP. Mr. Marmaro is the head of Skadden’s West Coast SEC enforcement and white collar defense practice and has offices in Los Angeles and San Francisco. Every land use decision is an economic development decision. Land use decisions influence, if not determine, where jobs are sited, where people live in relation to those jobs, and the tax base. These decisions also influence what resources are developed locally, and the degree to which we rely on imports, including imported oil. To secure economic prosperity for both the near and long term, land use decisions should be coordinated to be economically and environmentally "sustainable," so successful development strategies have relevance from one generation to the next. Complex Litigation XII - The Future of Civil Litigation: Legislative and Behavioral Changes For more than 25 years, litigants, judges, rulemakers, and legislators have grappled with questions surrounding complex civil litigation: pleading requirements, the scope of discovery, the appropriate role for the judge, the "disappearing trial," and other issues. Attempts have been made to objectively define these issues, measure the level of attorney dissatisfaction with the current system, and propose rule-based or statutory solutions. But many observers point out that the current rules are not used to full advantage by lawyers or judges to avoid disputes and delays, or to reduce costs in litigation. Behavioral changes may be needed address the problems that the litigation cost studies articulate. The 12th Annual Sedona Conference on Complex Litigation will bring together experienced public and private sector attorneys, judges, and legal academics from all points of view to examine these issues without any political agenda or pre-ordained solutions.
